On the night of December 4, 1890, David B. Burleigh, while on hit way to his residence in the city of Friend, *675stepped or fell off a sidewalk in said city, at a point Avhere the walk crossed a ravine some ten feet deep and fifty feet wide, receiving certain injuries from such fall from which he subsequently died.
