Appeal from an order of the Supreme Court (Cheeseman, J.), entered June 22, 1989 in *1051Albany County, which granted defendants’ motion to dismiss the complaint.

Plaintiff, an inmate at the Albany County Jail, brought suit against the county and its Sheriff to recover damages for injuries allegedly suffered on September 23, 1987 when plaintiff caught his right hand in a moving mechanical gate at the jail.
