Defendants were accused by information of the violation of section 337a, subdivision 2, of the Penal Code, in that they kept and occupied a “flat building” with paraphernalia for the purpose of recording wagers on horse races. They were convicted by the court sitting without a jury and have appealed from the judgment of conviction.
