This appeal was taken on the 19th day of June, 1916, from a judgment and order of the district court of the Second judicial district of the State of Nevada, in and for the county of Washoe, granting respondent a decree of divorce from appellant, and denying appellant’s motion for a new trial. Respondent, on the 14th day of October, 1916, filed with the clerk of this court a notice of motion for an order dismissing the appeal or affirming the judgment and order appealed from.
