SUBSTITUTE MAJORITY OPINION

We issued our original majority opinion in this case on April 10, 2014. Appellant filed a motion for rehearing. We overrule the motion for rehearing, withdraw our previous opinion, and issue this substitute opinion.
In this accelerated appeal, appellant Frederic Jardín challenges the trial court’s denial of his motion to dismiss the lawsuit under Chapter 27 of the Civil Practice and Remedies Code. See Tex. Civ.
