In the court below, where the parties appeared in their reverse order, and will hereinafter be so referred to, the plaintiff, Mary E. Waters, in a suit on a fire insurance policy against the defendant,. Niagara Fire Insurance Company, recovered a judgment of $1,000 for loss covered by the contract of insurance. Upon unsuccessful motion for a new trial and supersession of the judgment by bond, the defendant brought the cause to this court for review.
