On the 21st day of July, 1865, Albert McOargar was the owner of certain real estate in the city of St. Paul, and being about to erect a building-thereon,1 contracted with the plaintiff for his services as architect in erecting the same. The plaintiff brought this, suit in the Ramsey county District Court, against McOargar and certain other parties who had purchased said premises at a sale thereof upon the foreclosure of a mortgage executed by McOargar in July, 1866, to recover judgment against McOargar for the value of such services, and have the same adjudged a lien upon said premises. By the Gowrt. Section 1, Oh. 90^. 589, Gen. Stat., provides that “ whoever performs labor or furnishes *475materials or machinery for erecting, constructing, altering or repairing any house * * or other building, * "" by virtue of a contract or agreement with the owner or agent thereof, shall have a lien to secure the payment of the same,” &c., &c.'
