HAWKINS, Judge.
Appellant was convicted for the theft of two tons of maize heads of the value of $28; punishment being assessed at sixty days imprisonment in the county jail.
When the case was called for trial appellant filed a motion seeking to postpone the case two days, calling the court’s attention to the fact that the information had been filed the same day the case was called for trial." The court overruled the motion. We find no formal bill of exception complaining of this action of the court, and there does not appear in the record before us any order regarding the matter which was…
