Appellant was convicted for the murder of Hilario Moreno and his punishment assessed at confinement in the penitentiary for fifty years.

The killing occurred at a dance given by one Jesus Serna. From the state's evidence it is made to appear that the killing was inexcusable and that it came about under the following circumstances. The custom seems to have been at dances such as given on the night in question for the men dancers to pay the party at whose house the dance was given ten cents for each dance and to his female partner five cents.
