LIVELY, Circuit Judge.
OPINION
In this action, brought under the Americans with Disabilities Act (ADA), 42 U.S.C. § 12101, et. seq., the plaintiff complains that his employer discriminated against him by discharging him on account of a disability. The disability claimed by the plaintiff is alcoholism, a condition that is protected under the ADA. The question in this case is whether the employer violated the ADA by discharging the plaintiff for breaching the terms of a “last chance agreement” (L.C.A.), even though the breach related to the plaintiffs alcoholism.
