The defendant was convicted of murder of the first degree, the jury fixing the penalty at imprisonment in the state prison for life. (Pen. Code, sec. 190.)
This appeal is by the defendant from the judgment.
The homicide, resulting in the death of one E. G. Pierey from a gun-shot wound inflicted by the defendant, occurred at the Hotel Bird, in the town of Benicia, Solano County, on the night of the twentieth of February, 1913. The defendant was, at that time, and had been for some months previously, em ployed by the San Francisco Bridge Company, which was then operating in said town of Benicia.…
