ERROR to the District Court, Laramie County, Hon. Richard H. Scott, Judge. Tom Horn was convicted of murder in the first degree and sentenced to death for the killing of one Willie Nickell. He prosecuted error. The facts are stated in the opinion. The only evidence rightly admitted, that tends in any way to establish the guilt of plaintiff in error of the crime charged, is the so-called confession.

On information filed in the District Court of Laramie County, charging him with the murder of one William Nickell, the plaintiff in error, Tom Horn, was tried in said court and convicted of the crime of murder in the first degree, and sentenced to suffer the penalty of death imposed by statute upon that crime. Before sentence was pronounced a motion for new trial was filed 'and overruled, to which exceptions were reserved.
