ORDER

CRABB, Chief Judge.

In this civil action for money damages plaintiff contends that defendant converted wheat on which Farmers Home Administration (FmHA) had a perfected security interest. Jurisdiction is present under 28 U.S.C. § 1345. The case is before the court on plaintiff’s motion for partial summary judgment.

Because I find as a matter of law that, at the time of the grain sale at issue, defendant was a buyer in the ordinary course of business, defendant bought inventory from two farmers acting as a grain dealer not engaged in farming operations, and FmHA’s security interest in the…
