The plaintiff in error, hereinafter referred to as the defendant, was jointly charged with Limón Williams of the crime of the larceny of one heifer of the bovine species, the property of Get Russell; was tried separately and convicted, and sentenced to be imprisoned in the state penitentiary for a term of two years. Prom which judgment the defendant has appealed.
