INTRODUCTION
On December 21, 1992, the Debtor in Possession (“DIP”) filed a complaint against Ralph A. Bolden and other parties seeking, inter alia, “a determination that the debtor corporation is the proper and valid owner of” a Borg Warner vacuum forming machine, temperature controls, two vacuum tanks, four vacuum pumps and a hydraulic pump (collectively, the “machine”).
