The plaintiff, Gould Inc., originally filed a motion for partial summary judgment on April 29, 1992. By this motion, the plaintiff sought an order that the defendant, Continental Casualty Company, was obligated under the insurance policies it issued to the plaintiff to indemnify the plaintiff for the costs associated with an United States Environmental Protection Agency (“EPA”) mandated clean-up.
