This is a compensation case and the question to be determined is whether the plaintiff was an employee or an independent contractor.
The Minnick Hardware Company dealt in hardware and farm machinery and had been in business about five years. It had frequent need of the services of a repairman to do repairing and welding, but did not have enough work of that kind to justify the employment of a machinist and welder at full time.
