On January 29, 1917, Emaline C. Parson, plaintiff and appellant, began this action in the district court for Douglas county against defendants, in pursuance of the provisions of the Avorkmen’s compensation act, alleging generally that on March 23, 1910, her son Neis Parson, hoav deceased, Avhile in the employ of Edward Carr, one of the *543defendants, was kicked by a vicious mule that he was driving, and that was owned by Mr. Carr, and that as a result of the injuries so received heir son died two days thereafter.
