Bert Taylor and Taylor Smith, the defendants in a legal malpractice action, are pursuing a Rule 5, Ala.R.App.P., permissive interlocutory appeal from the denial of their motion to dismiss or for summary judgment. We will call these defendants-appellants "the lawyers." Because Vallarie D. Stevenson, the plaintiff-appellee before us, was the lawyers' client in her first lawsuit but is their antagonist in this second one, we will call her by her name, Stevenson.
