Nugent, who acquired half interest with said heirs of Robertson by deed, brought a petitory action against the Urania' Lumber Company, Limited, claiming to be the owners of lots Nos. 4 and 5 of section 28, township 11 north, range 2 east, containing 44.06 acres, more or less, setting up chain of title from the United States down to J.
