This cause has been before us -upon a former appeal, our decision being reported in 43 S. D. 166, 178 N. W. 575. It was then held that the attempted organization of the purported school corporation, of which defendants claim to be officers, was invalid, because there was then no statute authorizing the incorporating of an independent district into a consolidated school district. Such decision was filed and announced June 24, 1920, and remitttitur filed below July 15, 1920. On June 26, 1920, the Legislature enacted chapter 47, Laws Special Session 1920.
