Plaintiff Joshua Prowisor brings this § 1983 action against defendants the Town of Newburgh (the “Town”), Town -Police Officer Roger S. Roth, in his individual capacity, and Bon-Ton, Inc. (collectively, “defendants”) for violations of his Fourth and Fourteenth Amendment rights arising out of his detention by Bon-Ton department store security guards and subsequent arrest by Officer Roth based on suspicion of shoplifting.
