— This suit began as a wrongful death action. The Spokane County Fire Protection District No. (Fire District) appeals from a summary judgment dismissal .of its third-party complaint against Victor Holmes, husband of the deceased, Susan Marie Holmes, in which it sought to apportion any damages to be recovered in connection with the wrongful death action brought by her estate.
