This matter is before the Court on the motions of defendant Kevin Kinnard Gross, to vacate, set aside, or correct his sentence under 28 U.S.C. § 2255 and to modify his sentence under 18 U.S.C. § 3582(c)(2).
Defendant’s motions raise three claims. First, defendant Gross argues that his 120 *85month sentence violates the Fair Sentencing Act of 2010, which reduced the mandatory minimum sentence for the drug offense with which the defendant was charged from ten years to five.
