This is a rehearing granted in the case of Hutson v. Imperial Royalties Co., decided December 12, 1931, and reported in 134 Kan. 378, 5 P. 2d 825.

It has been exhaustively rebriefed and forcibly reargued. Perhaps some of the many intricate questions involved were not as fully covered by and discussed in the opinion as they should have been.
