The grand jury for the criminal court of Cook county on July 30, 1931, returned an indictment against the plaintiff in error, (hereinafter called the defendant,) together with John P. Havlicek, James Friedl and Albert J. Cermak, for the violation of section 4 of the general Banking act. (Cahill's Stat. 1933, chap. 16a, pp. 157, 158; Smith's Stat. 1933, chap. 16 1/2, pp. 196, 197.)
