The plaintiff, Mrs. Kruger, sued the defendant, Smith, to recover $25,000 ás compensation for the loss she sustained as the result of an alleged breach by the defendant of his promise to marry her. The -answer denies the averments of the complaint and as an affirmative defense pleads a written general release by the plaintiff under seal of all the present and future claims and demands whatsoever which she has or can or would or might have against the defendant.
