GARDNER, Chief Justice.

Basil M. Clarke, the father of Martha Minge Clarke Peach, presented a petition to the circuit court in equity seeking a modification of a decree entered in said court on June 17, 1943, wherein it was decreed that of the net income of the trust estate under the will of Susie M. Carter, deceased, petitioner, the father, should receive from the First National Bank of Birmingham, trustee under the will, 62%, and Martha Minge Clark Peach (then unmarried and referred to in the decree as Martha Minge Clarke) 38% of said net income.
