Appeal by the defendant, Bartholomew McGrane, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Rew York on the 1st day of July, 1896, upon the decision of the court rendered after a trial at the Rew York Special Term.

This is an action for the specific performance of a contract by which, in consideration that the defendant would convey to the plaintiff certain premises in the city of Mt. Vernon, Westchester *414county, and pay a certain sum of money to Mm, the plaintiff agreed to sell and convey to the defendant a lot of land on the southwesterly corner of Eighth avenue and One Hundred and Forty-eighth street in the ¡city of New York.
