The Commonwealth of Kentucky claims that Marathon Petroleum Company has used its dominant position in the Louisville and Northern' Kentucky gasoline markets to further its monopoly and thwart competition in violation of federal and state antitrust laws. (Docket No. 28) Marathon argues that the case should be dismissed because the Commonwealth is prohibited from bringing its claims and the complaint fails to state a plausible claim for relief.
