On July 28, 2008, plaintiff Hubert Cunningham filed this action against the United States of America pursuant to the Federal Tort Claims Act, 28 U.S.C. §§ 2671-2680 (“FTCA”), seeking damages for injuries suffered as a result of an incident that occurred on the morning of August 7, 2002, at the Veterans Administration Hospital (“VA Hospital”) in Brooklyn, New York.
