Presently before the Court is the partial motion to dismiss of defendant CSX Transportation, Inc. (“CSX”), pursuant to Fed. R.Civ.P. 12(b)(6), and the response of plaintiff Jon Schouten (“Schouten”) thereto. 1 Specifically, CSX moves to dismiss the claims of Schouten alleging discrimination on the basis of national origin and in unlawful retaliation under Title VII of the Civil Rights Act of 1964 (“Title VII”) and the Pennsylvania Human Relations Act (“PHRA”), as well as the claims of Schouten alleging discrimination on the basis of…
