The appellant company instituted this suit against appellee to recover a balance of $828.54 alleged to be due under a written contract dated on the 4th day of September, 1913. By the terms of the contract, which will be later set out, appellee purchased from the appellant 15,000 bushels of No. 3 white oats at the contract price of 55½ cents per bushel for December shipment, basis Texas group 1, with the option of carrying after December 31, 1913, at a quarter of a cent per bushel for each 10 days, until May 1, 1914.
