WIENER, J.

A jury convicted Robert Rick Lee of forcible rape (Pen. Code, § 261), first degree burglary (Pen. Code, § 459), robbery (Pen. Code, § 211), and forgery (Pen. Code, § 470). Thereafter, the court found him to be a mentally disordered sex offender (MDSO) who could benefit by treatment and committed him to Patton State Hospital. Approximately 18 months later he was returned to the committing court under Welfare and Institutions Code section 6325, subdivision (b) 2 which found him to be an MDSO who could not benefit from further treatment.
