Werner, J.:

In the evening of June 17th, 1912, a Chinaman named Yee Toy was shot and killed in Pell street in the county of New York. The defendant was arrested, charged with the crime of murder in the first degree, held for the grand jury and indicted. He has been twice tried. On the first trial the jury disagreed, and on the second trial he was found guilty. The appeal is from the judgment entered on the verdict. In view of the disposition which we deem it necessary to make of this appeal, we shall discuss only such facts as are germane to the questions presented.
