This matter is before the Court upon motion for summary judgment by defendants Midwesco Enterprise, Inc. and Mid-Atlantic Pipe Corporation pursuant to Rule 56 of the Federal Rules of Civil Procedure.

The facts that gave rise to this dispute are as follows: In August, 1973, plaintiff Fisher, Inc. learned that Wright-Patterson Air Force Base at Dayton, Ohio intended to invite bids on the installation of certain underground high temperature hot water lines.
