Plaintiff brought this action as the as-signee of a number of creditors, of which he is one. In his complaint he set out eighteen causes of action, a number of them being similar in their allegations in that plaintiff attempted to recover on four different theories of law as follows: (1) That a partnership existed between defendants John Gurley, Robert T. Crawford, Kenneth R. Crawford, Marshall O.
