Appeals from two orders of the County Court of Cortland County (Smith, J.), entered March 1, 2000 and March 2, 2000, which granted defendants’ motions to dismiss the indictment.

Defendant Sheldon O’Neill was indicted on a number of charges, including conspiracy in the fifth degree and seven counts of criminal sale of a controlled substance in the fourth degree, based upon his alleged involvement in a drug ring with *670defendant Luis Agüero Maidana and two other codefendants.1 The indictment charged Maidana with a single count of conspiracy in the fourth degree.
