This case is before us again, after we remanded it for the trial court to reconsider its denial of defendant’s motion to dismiss on statutory speedy trial grounds. State v. Allen, 205 Or App 219, 134 P3d 976 (2006) (Allen I). Pursuant to that remand, the trial court denied defendant’s motion to dismiss and reinstated his conviction for driving under the influence of intoxicants (DUII), ORS 813.010.
