The first question raised in.the record of this case is upon the action of the court below in excluding the testimony of the witness John Van Frank.

The action was by the appellee against the appellant .upon account for work and labor done. The second paragraph of the answer is a plea of set-ofij wherein it is shown that the plaintiff was and had been a tenant upon the farm of the appellant, under a written agreement or lease, wherein and whereby it was, among other things, provided that the plaintiff should sow and harrow in clover upon certain fields where wheat was then growing.
