This action was brought in the Court of Common Pleas for Williamsburg County, to recover damages alleged to have been sustained by the plaintiffs by fire which burned over their lands near Cades, S. C., on the 14th day of June, 1934. The complaint alleges that on that day, at about 12:30 o’clock p. m., a locomotive engine of the defendant, pulling a southbound freight train, communicated fire to the eastern edge of the defendant’s right of way, which fire, as a result of a strong wind blowing in the direction of plaintiff’s land,…
