Merrell, J.:

These appeals come before this court under circumstances deserving brief comment before discussing the merits thereof. It appears from the opinion of the learned justice presiding at Special Term when the orders appealed from were granted that some time prior to the making of the motions resulting in the orders now before us, a similar motion made on behalf of the other individual defendants had been denied by another justice.
