At the general election held in November, 1892, the relator was a candidate for the position of long-term school trustee of Carson school district, and received a majority of the votes cast for that position. The question involved in this proceeding is whether the relator or the defendant Cutts is entitled to the position of long-term school trustee of Carson school district No. 1, commencing January, 1893. The relator founds his right thereto both upon an election at the general election of 1892, and upon an appointment made in .January, 1893.
