As an appeal on questions of law and fact from the Common Pleas Court of Cuyahoga County, this cause is before us for hearing de novo upon the pleadings and the stipulations.
The action was initiated by plaintiffs, appellees herein, against the County Commissioners, the County Sanitary Engineer, the Treasurer of Cuyahoga County and the Auditor of Cuyahoga County, seeking to enjoin the further collection and enforcement of collection of tap-in charges which were levied by the County Commissioners against properties of plaintiffs.
