In this action the plaintiff seeks to recover damages for the personal injuries he sustained while employed by the defendant as a furniture salesman. The jury returned a verdict in favor of the plaintiff for $6,000. The trial court granted defendant’s motion for a judgment notwithstanding the verdict of the jury. The defendant concedes that the sole ground upon which this motion could have been granted was that plaintiff-appellant was guilty of contributory negligence as a matter of law. The jury had been properly instructed on negligence and contributory negligence.
