OPINION ON CROSS-MOTIONS FOR SUMMARY JUDGMENT

This case comes before the court on the plaintiff’s motion for partial summary judgment pursuant to Rule 56 of the Rules of the United States Court of Federal Claims (“RCFC”) and the government’s cross-motion for summary motion, as well as the government’s motion to dismiss for failure to state a claim pursuant to RCFC 12(b)(6).1 The plaintiff, California Oregon Broadcasting, Inc.
