The appeal in this case is by the plaintiff in an *170action by her against the city of Herington to recover damages for injuries sustained while walking on a sidewalk in the city, alleged by her to have been defective, where the jury returned a verdict for the defendant city.

The petition contained the usual allegations as to the defect in the pavement, the negligence of the city in permitting it to so exist and remain, the way the accident occurred and the extent of the injuries sustained. The answer of the city pleaded a general denial and…
