FOGEL, District Judge.
Wells Fargo & Company (“WFC”) and Wells Fargo Bank, N.A. (collectively, “Appellants”) appeal an order of the United States District Court for the Eastern District of Texas denying Appellants’ motion to dismiss or stay pending arbitration litigation brought by Datatreasury Corp. *1370(“Appellee”)- This Court heard oral argument on November 6, 2007. Because the parties are not bound by the operative arbitration clause, we affirm.
