OPINION

{¶ 1} This is an appeal from a tort complaint arising out of an automobile accident in July, 2002. Appellant Nick Stanton ("Stanton") filed the complaint in the Belmont County Court of Common Pleas alleging that Appellee Joseph Holler ("Holler") was driving under the influence of alcohol and hit Appellant head-on, then fled the scene of the accident. The parties entered in settlement negotiations.
