Appeal from a decree of the district court for Douglas county enjoining tbe collection of a promissory note and canceling a chattel mortgage given to secure its payment. The defendants contend that the trial court erred in allowing the plaintiff to interpose the plea of usury, and this question will be determined first in the order of the assignments.

It appears that the plaintiff and his brother, Ernest Bolen, were engaged as partners in the transfer business in South Omaha, Nebraska, under the name and siyle of Bolen Brothers, and on the 15th day of June, 1907, borrowed of the defendant…
